Lived Experience from a Legal Practitioner: Navigating Due Diligence, Supervisory Obligations and Criminal Negligence Laws in Canada in the Mining Context (4h)

This course will canvass a variety of legal topic areas in Canadian health and safety law as it pertains to mining operations.

Short Course Objectives:

To provide attendees with an enhanced understanding of their legal obligations from a health and safety perspective on important topics such as supervisor responsibility, prime contractor obligations, criminal negligence, and the evolving nature of due diligence requirements in Canada.

Target Audience: 

All attendees, including any Senior Officer of a Mining Organization, Engineers and Health and Safety Professionals.

Abstract

This course will canvass a variety of legal topic areas in Canadian health and safety law as it pertains to mining operations. This four-hour course will cover three segments in 55–60-minute tranches, with 15 minutes for questions and answers:

  1. Navigating Prime Contractor Obligations and Supervisory Obligations in the Mining Context;
  2. Establishing Due Diligence and Creating Frameworks that will Enhance Safety and Withstand Legal Challenge;
  3. Understanding Criminal Negligence Laws under Canada’s Criminal Code.

John Agioritis, K.C.

John Agioritis, K.C. is a Partner at MLT Aikins LLP. John leads the firm’s Occupational Health and Safety Practice Group. He provides trusted advice and counsel to corporate clients navigating their way through various types of emergencies, crises and incident response, predominantly in the workplace safety context. 

John is an experienced litigator that represents corporations and entities in sensitive, complex and high-stakes regulatory investigations, trials and appeals. He has extensive experience navigating incidents in the mining context. He also provides pro-active advice on compliance programs and due diligence measures designed to meet and exceed regulatory obligations under several federal and provincial statutes. 

John is also frequent speaker and commentator on matters of occupational health and safety, labour law and policy. 

Outside of work, John is an active community member and is currently acting as Director of the Saskatoon Community Foundation, and Chair of the OHS Subcommittee of the Canadian Association of Counsel to Employers (CACE).
